1. About these terms

These Terms of Service ("Terms") govern your use of WorkerRecord ("the Service"), operated by WorkerRecord Ltd ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

These Terms are governed by the law of England and Wales.

2. The Service

WorkerRecord is a software-as-a-service platform that allows construction contractors ("Contractors") to collect, store, and monitor compliance documents from their subcontractors. The Service includes:

You must be at least 18 years old and have authority to enter into a binding contract on behalf of any business you represent. You are responsible for maintaining the security of your account credentials and for all activity under your account.

You must provide accurate and complete information when registering and keep it up to date.

4. Subscription and payment

Access to the Service requires a paid subscription. Pricing is as displayed on our website at the time of subscription. Payments are processed by Stripe. By subscribing, you authorise us to charge your payment method on a recurring monthly basis.

Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time via your billing portal; access continues until the end of the current billing period. We do not offer refunds for partial periods.

SMS and WhatsApp message credits are non-refundable once consumed. Unused purchased credits roll over indefinitely; unused monthly free credits expire at the end of each calendar month.

Your use of the Service is also governed by our Privacy Policy and Data Processing Agreement, both of which are incorporated into these Terms by reference. You retain ownership of all data you upload to the Service. By uploading data, you grant us a limited licence to store and process it solely to provide the Service to you.

You are responsible for ensuring you have the lawful basis to collect and share compliance documents from your subcontractors under applicable data protection law (including UK GDPR).

7. Intellectual property

The Service, including its software, design, and content, is owned by us and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes during your subscription term.

8. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Service.

Our total liability to you in any 12-month period shall not exceed the amount you paid us during that period.

WorkerRecord is a compliance management tool. It does not constitute legal advice, and we do not guarantee that use of the Service ensures compliance with any specific legal or regulatory requirement. You remain responsible for ensuring your supply chain meets all applicable laws and standards.

9. Service availability

We aim to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or suspend the Service for technical reasons. We will endeavour to provide advance notice of planned downtime.

10. Termination

You may cancel your subscription at any time. We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if you fail to pay applicable fees.

On termination, you may export your data using the in-app export tools before your access ends. We will retain your data for 30 days after termination, after which it will be permanently deleted.

11. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.
